§ 1. Definitions
1.1. Platform / Service – the “Academy of Ink” e-learning service operated by the Service Provider at: www.academyofink.com and related subpages and features.
1.2. Service Provider / Company – Academy of Ink Sp. z o.o., ul. Zygmunta Słomińskiego 15/502, 00-195 Warsaw, Poland, KRS 0001150744, NIP 9522265363, REGON 540699565.
1.3. User / You – any person using the Platform (consumer or trader/entrepreneur), regardless of whether they have an Account.
1.4. Account – a panel assigned to the User within the Service.
1.5. Course / Digital Content – online educational materials in video form (hosted i.a. on Bunny.net), and any accompanying files.
1.6. Access Period – the time during which the User has access to the purchased Course; for each Course it is 3 months from the moment access is granted, unless stated otherwise on the offer page.
1.7. Business Days – Mon–Fri, excluding public holidays in Poland.
1.8. Terms – this document.
The expressions “in particular” and “includes” mean “but are not limited to”.
§ 2. General Provisions
2.1. These Terms set out the rules for providing electronic services and the rules for concluding and performing contracts for the supply of digital content.
2.2. Upon registering an Account, placing an order, or first using the Service, you accept the Terms. Persons aged 13–15 may use the Service only with the consent of a legal guardian; minimum age to use without consent: 16+.
2.3. The provisions of the Terms do not prejudice the mandatory provisions of the country of the Consumer’s habitual residence.
§ 3. Technical Requirements
3.1. A device with Internet access, a current web browser (Chrome/Firefox/Safari/Edge), cookies and JavaScript enabled, the ability to play video (Bunny.net). A broadband connection is recommended.
3.2. Scheduled maintenance windows are allowed (where possible – communicated in advance).
§ 4. Registration, Account and Termination
4.1. Registration requires at minimum: an email address and password, as well as acceptance of the Terms and the Privacy Policy.
4.2. The User provides true and up-to-date data. The Account is non-transferable; sharing login credentials with third parties is prohibited.
4.3. The Service Provider may limit Account functionality in the event of violations or reasonable suspicions of abuse.
4.4. Account deletion / termination: you may request deletion of your Account (email: kacper@academyofink.com). Deleting an Account does not affect the validity of concluded Course sales contracts; no refunds are given for any unused Access Period, unless mandatory law provides otherwise.
§ 5. Orders, Payments and Delivery of Digital Content
5.1. Prices are displayed in EUR, USD and PLN and—where applicable—include taxes in accordance with applicable law (e.g., VAT OSS).
5.2. Payments are handled by: Stripe Payments (incl. cards, Apple Pay, Google Pay, selected local methods) and Tpay (Krajowy Integrator Płatności S.A.)—according to the methods currently available on the order page.
5.3. Once your payment method is successfully charged, you gain access to the Course for 3 months (the Access Period), unless the offer states otherwise.
5.4. Delivery of Content is exclusively digital (streaming / and downloading if provided).
5.5. Chargebacks / payment disputes: any chargeback procedures are carried out in accordance with the rules of payment processors and payment schemes.
5.6. In justified cases, the Service Provider may modify the scope of available Content (e.g., removal of material for licensing reasons); in such a case, equivalent access or a proportional refund will be provided.
5.7. Tpay payments. If you choose Tpay, you may be redirected to the operator’s secure website. The terms for processing payments, payment complaints and transaction verification are defined by Tpay (Krajowy Integrator Płatności S.A.). We do not store card/payment data from this channel other than the data necessary to identify the order (e.g., transaction ID and amount).
5.8. Tpay trademarks and materials. The Service may display Tpay marks and logos solely to inform about available payment methods. These marks are the property of Tpay/Krajowy Integrator Płatności S.A.
§ 6. License and Intellectual Property
6.1. The Content is protected by copyright; all rights are reserved by the Service Provider or its licensors.
6.2. You receive a non-exclusive, non-transferable license for personal, non-commercial educational use during the Access Period.
6.3. It is prohibited to copy, share, publicly distribute, resell, circumvent security measures, or record the stream without prior written consent.
6.4. UGC (user-generated content, e.g., assignments, comments):
a) rights to UGC remain with the User;
b) the User grants the Company a non-exclusive license to display UGC within the Platform and courses;
c) using UGC in marketing requires a separate, explicit consent.
§ 7. Liability and Warranties
7.1. The Content and information are educational in nature; learning outcomes depend on the User.
7.2. To the maximum extent permitted by law, the Company is not liable for indirect damages, lost profits, or interruptions in access resulting from causes beyond its control (force majeure, supplier outages).
7.3. Nothing in these Terms excludes liability that cannot be excluded (e.g., wilful misconduct; consumer protection).
§ 8. User Conduct
8.1. The following are prohibited, inter alia: violating the law; submitting unlawful/defamatory/obscene content; infringing copyrights; attempts at unauthorised access; distributing malware; spam.
8.2. A breach may result in, inter alia, Account blocking, functionality restrictions, termination without refund.
§ 9. Complaints and Withdrawal (EU Consumers)
9.1. Service complaints: kacper@academyofink.com; response within 14 days.
9.2. 14-day right of withdrawal (digital content): you have this right until the start of performance. If you consent to the supply of the digital content before the 14-day period expires and acknowledge the loss of the right of withdrawal—this right expires when access is granted/the stream is launched (based on Article 38(13) of the Polish Consumer Rights Act).
9.3. Cancellation during the 3-month Access Period does not entitle you to a proportional refund unless mandatory provisions state otherwise.
§ 10. Amendments to the Terms
10.1. The Company may amend the Terms for valid reasons (changes in law, feature development, security).
10.2. Material changes will be notified at least 14 days in advance (email/notification in the Panel).
10.3. If you do not accept the changes, you may terminate the agreement effective the day before the changes come into force.
§ 11. Governing Law, Court, ADR/ODR
11.1. These Terms are governed by Polish law and do not exclude protection granted to consumers by the mandatory provisions of their country of residence.
11.2. EU consumers may use the ODR platform: https://ec.europa.eu/consumers/odr/
11.3. Disputes with Users who are not consumers – the court having jurisdiction over the Company’s registered office.
§ 12. Final Provisions
12.1. Informational materials (FAQ, blog) do not constitute legal advice or a guarantee of outcomes.
12.2. If any provision proves invalid, the remaining ones remain in force; the invalid provision shall be replaced by one that best reflects its purpose under applicable law.
